Likert-scale surveys are frequently used in cross-cultural studies on leadership. Recent publications using digital text algorithms raise doubt about the source of variation in statistics from such studies to the extent that they are semantically driven. The Semantic Theory of Survey Response (STSR) predicts that in the case of semantically determined answers, the response patterns may also be predictable across languages. The Multifactor Leadership Questionnaire (MLQ) was applied to 11 different ethnic samples in English, Norwegian, German, Urdu and Chinese. Semantic (...) algorithms predicted responses significantly across all conditions, although to varying degree. Comparisons of Norwegian, German, Urdu and Chinese samples in native versus English language versions suggest that observed differences are not culturally dependent but caused by different translations and understanding. The maximum variance attributable to culture was a 5% unique overlap of variation in the two Chinese samples. These findings question the capability of traditional surveys to detect cultural differences. It also indicates that cross-cultural leadership research may risk lack of practical relevance. (shrink)

Explainable artificial intelligence (XAI) is an emerging, multidisciplinary field of research that seeks to develop methods and tools for making AI systems more explainable or interpretable. XAI researchers increasingly recognise explainability as a context-, audience- and purpose-sensitive phenomenon, rather than a single well-defined property that can be directly measured and optimised. However, since there is currently no overarching definition of explainability, this poses a risk of miscommunication between the many different researchers within this multidisciplinary space. This is the problem we (...) seek to address in this paper. We outline a framework, called Explanatory Pragmatism, which we argue has two attractive features. First, it allows us to conceptualise explainability in explicitly context-, audience- and purpose-relative terms, while retaining a unified underlying definition of explainability. Second, it makes visible any normative disagreements that may underpin conflicting claims about explainability regarding the purposes for which explanations are sought. Third, it allows us to distinguish several dimensions of AI explainability. We illustrate this framework by applying it to a case study involving a machine learning model for predicting whether patients suffering disorders of consciousness were likely to recover consciousness. A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the autonomy conception (...) of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. In the jurisprudence of constitutional courts around the world, there is an emerging trend towards an autonomy-based understanding of constitutional rights: increasingly, rights are interpreted as being about enabling people to live autonomous lives, rather than disabling the state in certain ways. This article investigates the conception of autonomy employed by courts by presenting two candidates and examining which of them explains the current practice of constitutional rights law better. The first, labelled the excluded reasons conception of autonomy, claims that (...) a person’s autonomy is violated if he is treated on the basis of certain impermissible—in particular, moralistic or paternalistic—reasons. It is concluded that, while this is a coherent understanding of autonomy, it cannot explain many of the rights that are widely accepted today. The second, the protected interests conception, argues that a person has autonomy interests in controlling certain domains of her life, and offers a scale on which the importance of the various autonomy interests can be assessed. The article demonstrates that this conception is coherent and adequately explains the current practice. The final section briefly explores some implications of this result for a comprehensive reconstructive theory of constitutional rights. (shrink)

The essay responds to a challenge posed by Vanessa MacDonnell and examines the question of stability and change under the global model of constitutional rights. Constitutionalism offers the promise of both stability and justice, but it may seem that there will often be a tension between these values. While some have accused the global model, and in particular proportionality, of overemphasizing justice at the cost of stability, MacDonnell claims that it underemphasizes the necessity of social change. In this response, I (...) argue that in the long run the push for social change and towards justice can be realized only when there is also a certain stability, namely the stubborn democratic insistence that any state action must be reasonably justifiable to those affected by it in terms of their freedom and equality. This conviction lies at the core and will be reinforced by the endorsement of the global model of constitutional rights. (shrink)

This article considers the Pauline construction of a “spiritual body” in 1 Corinthians 15 and his flesh/spirit dualism more generally in light of Paul’s probable disability. I suggest that this rhetoric functioned as a strategy for Paul to claim social power in his social context by deemphasizing his physical presence, and thus reflects a negotiation with cultural patterns of disability abjection rather than a meaningful part of Christian teaching. Because of the active harm done by these dualistic constructions, however unintentional (...) such an interpretation may have been on Paul’s part, liberative Christian theologies must reject this framing and work to integrate not just “body” and spirit but also flesh and its more negative bodily associations such as weakness, pain, illness, and death. In this essay, I argue for a historical-critical perspective on rationality. In our global age, we in the West need to come to terms with the fact that non-Western traditions have developed complex forms of practical rationality. I will first give an overview of what I call the “Confucian standards of reasoning.” Secondly, I will explain how the Neo-Confucian thinker Zhu Xi 朱熹 has rearticulated the earlier understanding of practical reasoning. Thirdly, I will demonstrate why a comparative perspective may enrich (...) our reasoned engagement with individuals in the Chinese-speaking world. There are, it is argued, conceptually and empirically adequate naturalistic explanations of religion that explain religion without explaining it away and without leaving out anything needed fully to comprehend religious phenomena. Moreover, naturalistic explanations arc sometimes also critiques of religion. This article concerns itself with a subspecies of such explanations through articulating and defending some naturalistic criticisms of the truth-claims of religion. The rationale is displayed for naturalistic thinkers going from truth-claim analyses to functional analyses and the central naturalistic explanations (...) of the roles and functions of religion are distinguished and related. In a crucial passage in the Republic found within a discussion of women’s role in the ideal polis, division of eidē is identified as necessary for dialectic. A careful consideration of the way division is described in this passage reveals that it resembles the procedure of division described in the Phaedrus and the Sophist and that this procedure, when carried out correctly, is central to dialectic according to the Republic and helps set dialectic apart from eristic. Consideration of additional passages (...) in the Republic indicates that division may be employed on different kinds of entities, such as virtues and types of human natures; for according to the argument of the Republic, the correct use of division for the purpose of distinguishing types of human natures or virtues, entities that to the untrained eye may look alike but are distinct by nature, is required for achieving the knowledge philosophers and philosopher-rulers need. In fact, correctly performed divisions help the dialectician to bring into focus a subject matter under consideration in a kind of double-vision that reveals that matter as a concrete phenomenon that exhibits participation in different eidê when it is considered from different points of view. It is fair enough to refer, as Father Clarke does, to the God of the Christians and the Jews as ‘the one infinite Creator of all other things’. It is reasonable to take ‘God’ as a term that has certain conditions associated with it. These conditions fix its meaning. The central conditions associated with ‘God’ are: being infinite or unlimited, eternal, self-existent, the creator of everything that exists other than himself, the being upon whom all other beings are dependent but (...) who depends on nothing himself, being personal, good, loving and holy. These conditions determine our concept of God, determine what could count as a referent for the term ‘God’. In short, God, as John Hick remarks, is conceived in Western Religions ‘as the infinite, eternal, uncreated, personal reality, who has created all that exists other than himself, and who has revealed himself to his human creatures as holy and loving’. I discuss the justification of political violence even within democracies. I define ?violence? and indicate how its evaluative force sometimes has conceptually distorting effects. Though acts of violence are at least prima facie wrong, circumstances can arise where, even in democracies, some of them are morally justified. To establish this, three paradigm cases of non?revolutionary political violence are examined. The question is then discussed whether revolutionary violence is ever justified as a means of establishing or promoting human freedom and happiness. (...) During the last few decades there has been an enormous increase in locally based historical plays in Norway. These are staged by amateurs, although professionals may hold important positions both on and behind the stage. The dramas have their origin in actual or invented historical events located in the area, and the stage is carefully selected to create an aura of authenticity to the performance. The environment creates dramatic scenery as they are mostly staged outdoor, and the audience frequently have (...) to make an effort to travel to the site of the performance. As the plays are staged annually or biennially, they constitute a regular ritual performance in the community. At the same time, minor changes are allowed for from year to year, and which are widely discussed and appraised by the audience and others. Although these dramas claim to represent historical events and period pictures, their underlying message is of current interest. They become mediums whereby the past is seen through the ideological and moral lenses of the present, and are also catalysts for creating selected memories for the future. As such, they should also be considered on the background of the wider social dramas surrounding the actual plays. (shrink)
